In this webinar, state tax expert Michael Fleming will cover certificates and drop shipping. Mike will go over the importance of documenting exceptions correctly because an exemption that is not documented correctly is very often not viewed as an exempt sale. Missing, invalid, or incorrectly filled out certificates is generally the biggest reason for large audit assessments in an audit for those companies that have a responsibility to collect certificates.
It is not good enough to just collect a certificate, someone has to make sure the certificate would survive an audit. This process is called validation, and Mike will discuss the most common reasons certificates are kicked in an audit and how to avoid them. He will also cover good faith acceptance and common sense requirements.
Drop shipping generally complicates the certificate management function causing companies that do drop shipping to have the biggest certificate problems. The problems are not just limited to tax but can be customer service related which can lead to drops in sales. Mike will go over scenarios where some companies are being too tough in their collection efforts as well as where they are being too lax. In this section, Mike will talk about alternative documentation that can sometimes be provided by a customer when they are not registered in a state and do not have nexus. It works in about 37 states or so.
